    Terms of Service

    These Terms of Service govern your access to and use of WhatsInPattaya.com. By accessing or using this website, submitting or claiming a listing, creating an account, or purchasing a listing or service, you agree to these Terms, our Disclaimer and our Privacy Policy. If you do not agree, you must not use the website or submit any content.

    1. About the Service

    WhatsInPattaya.com (“WIP”, “we”, “us” or “our”) operates an independent online business directory, property-listing platform and local information website for Pattaya and surrounding areas.

    Listings may be submitted by businesses, owners, authorised representatives or other users, or may be compiled from publicly available information. The appearance of a listing does not necessarily mean that the listed business submitted, claimed, approved or paid for it.

    2. Listing Types and Eligibility

    WIP may offer Basic (FREE), Premium and Featured Business listings. Available features, prices, duration and promotional benefits are those displayed or communicated at the time of submission or purchase.

    Basic (FREE) listings are only available to businesses with business premises open to customers during their published opening hours. Businesses without premises that customers can visit must select a Premium or Featured Business listing.

    Submission does not guarantee publication. All listings are subject to review and approval. We may reject, edit, correct, recategorise, combine, restrict, unpublish or remove any listing, or require the selection of a Premium or Featured Business listing where a submission does not qualify for a free listing.

    3. Submitting and Claiming Listings

    Anyone submitting or claiming a listing represents that they are legally authorised to act for the relevant business or property and that all information supplied is accurate, lawful, current and not misleading.

    A claim request does not automatically establish ownership or authority. We may request evidence and may refuse, delay or cancel listing-management access where authority cannot be established or where competing or disputed claims are received.

    You must not submit, claim or attempt to control a listing without proper authority, impersonate another person or business, or provide false or misleading ownership information.

    4. Premium and Featured Business Payments

    Premium and Featured Business listings require payment. After reviewing the submission, WIP will provide payment instructions, including our Thai bank account details, by email. Payment must be made by bank transfer unless we expressly agree to another method in writing.

    A paid listing will not be activated until the applicable fee has been received as cleared funds. The price, listing period and included features will be those displayed on the website or confirmed to you before payment.

    All fees are non-refundable once paid, including where the purchaser later changes their mind, stops trading, fails to provide required information, requests early removal or does not receive the level of response expected, except where a refund is required by applicable law or expressly agreed by WIP in writing.

    Payment does not guarantee enquiries, bookings, customers, sales, revenue, website traffic, search-engine rankings or any other commercial result.

    Featured Business listings may receive enhanced placement and promotional exposure across the website. The precise location, frequency, rotation, format and visibility of that exposure may vary according to website design, available space, device type and other operational considerations. No particular position or number of impressions is guaranteed unless expressly agreed in writing.

    5. Accuracy and Updates

    Submitters and listing managers are responsible for checking their listings and notifying us of material changes, including changes to addresses, contact information, opening hours, ownership, prices and available services.

    Although we may correct or update information, we are under no obligation to monitor every listing continuously or guarantee that information remains accurate, complete or current.

    6. User Content and Permissions

    You remain responsible for all text, photographs, videos, logos, graphics, documents, contact details and other materials that you submit, upload, send or otherwise make available to WIP (“User Content”).

    By providing User Content, you represent and warrant that:

    •You own the content or have all necessary rights, licences and permissions to use and submit it.

    •Its publication will not infringe copyright, trademark, privacy, publicity, confidentiality or any other right.

    •The content is accurate, lawful and not misleading.

    •Any identifiable person appearing in the content has provided any permission required for its intended use.

    •You are authorised to publish any business, personal or contact information included in the submission.

    By submitting User Content, you grant WIP a non-exclusive, worldwide, royalty-free licence to host, store, copy, reproduce, crop, resize, format, edit, adapt, publish, display, distribute and promote that content for the purposes of operating, marketing and improving the website, directory and relevant listing.

    This licence includes permission to use submitted content in website previews, directory pages, search results, social-media promotions and other promotional material connected with WIP. It continues for as long as the content is published and for any reasonable period required for backups, records, legal compliance and administration after removal.

    7. Prohibited Content and Conduct

    You must not use the website to submit, publish or distribute anything that is unlawful, fraudulent, deceptive, defamatory, threatening, abusive, discriminatory, obscene, malicious, infringing or otherwise inappropriate.

    You must not:

    •Submit false, duplicated, fabricated or deliberately misleading listings.

    •Publish another person’s private information without proper authority.

    •Upload viruses, malware or harmful code.

    •Send spam or use the website for fraudulent activity.

    •Attempt unauthorised access to the website, its accounts, servers or systems.

    •Circumvent security, access restrictions or listing requirements.

    •Interfere with the normal operation of the website.

    •Use automated systems to place unreasonable demands on the website.

    8. Website Content and Intellectual Property

    Except for third-party and User Content, the WIP name, branding, logo, design, layout, original descriptions, graphics, photographs, compilations, database organisation and other original website content are owned by or licensed to WIP and are protected by applicable intellectual-property laws.

    Business names, trademarks, logos, photographs and other third-party materials remain the property of their respective owners. Their appearance on WIP does not transfer ownership to us or imply sponsorship, affiliation or endorsement.

    You must not systematically copy, scrape, extract, reproduce, republish, sell, license, distribute or use WIP content to create or support a competing directory, database, website, product or service without our prior written permission.

    Limited quotation or linking for legitimate personal, editorial or informational purposes is permitted where allowed by law, provided that the source is properly identified and the use is not misleading.

    9. Review, Removal and Access Restrictions

    WIP reserves the right, but assumes no obligation, to monitor submissions and website activity.

    We may reject, edit, correct, reformat, recategorise, restrict, unpublish or remove any listing, account or other content where we reasonably consider it inaccurate, misleading, duplicated, outdated, unauthorised, unlawful, infringing, unsafe, abusive, low quality, contrary to these Terms or otherwise unsuitable for the website.

    Where an account or listing-management function is provided, we may restrict, suspend or terminate access where reasonably necessary to protect WIP, website users, listed businesses or third parties. We may act without advance notice where immediate action is reasonably necessary.

    Removal or restriction of content does not constitute an admission that the content was unlawful, inaccurate or infringing.

    10. Third-Party Businesses and Advertisers

    Any communication, visit, booking, purchase, payment, transaction, contract or other dealing between a website user and a listed business, advertiser, service provider, property owner, agent or other third party is strictly between those parties.

    Unless expressly agreed otherwise in writing, WIP is not a party to, agent for, guarantor of or adviser in relation to those dealings. We do not guarantee the identity, reliability, legality, qualifications, products, services, conduct or performance of any listed person or organisation.

    WIP is under no obligation to investigate, mediate or become involved in disputes between website users, businesses, advertisers or other third parties.

    11. Real Estate Listings and Services

    Property listings are provided for informational and marketing purposes. Availability, prices, descriptions, dimensions, photographs and other details may change and must be independently verified.

    We do not guarantee ownership, title status, legal compliance, permitted use, availability, condition, dimensions, pricing, rental terms or suitability of any property.

    Buyers, sellers, landlords and tenants are responsible for conducting inspections, checking ownership and title documents, obtaining appropriate legal and professional advice and completing their own due diligence.

    Where WIP acts as an intermediary, introducing party or co-agent in a particular transaction, any specific commission, agency or service arrangement may be governed by separate written terms agreed for that transaction.

    12. External Links and Services

    The website may contain links to external websites, maps, social-media pages, booking systems, messaging services, payment providers or other third-party resources.

    These are provided for convenience only. We do not control and are not responsible for their availability, accuracy, security, privacy practices, content, products, services or conduct. Accessing or using an external service is at your own risk and subject to that service’s own terms and policies.

    13. No Warranties

    The website and its content are provided on an “as is” and “as available” basis.

    To the fullest extent permitted by law, WIP makes no representation or warranty that the website or any listing will be accurate, complete, reliable, lawful, suitable, secure, uninterrupted, error-free, continuously available or free from harmful components.

    14. Limitation of Liability

    To the fullest extent permitted by law, WIP and its owners, operators, employees, contractors and agents shall not be liable for loss, damage, cost or expense arising from or connected with:

    •The use of or inability to use the website.

    •Reliance on inaccurate, incomplete or outdated information.

    •The conduct, products, services, acts or omissions of a listed business or third party.

    •Communications, visits, bookings, payments, transactions or disputes involving third parties.

    •External websites, links, maps, platforms or services.

    •Unauthorised access, malware, interruptions, technical faults or data loss.

    •The rejection, editing, movement, restriction or removal of a listing or other content.

    •Any failure to achieve enquiries, traffic, ranking, sales or other expected results.

    To the fullest extent permitted by law, WIP shall not be liable for any indirect, incidental, special, punitive, exemplary or consequential loss, or any loss of profit, revenue, business, contracts, data, goodwill, reputation or opportunity.

    Where liability relating to a paid listing or service cannot lawfully be excluded, WIP’s total aggregate liability shall not exceed the amount actually paid to WIP for the specific listing or service giving rise to the claim.

    Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

    15. Indemnity

    To the fullest extent permitted by law, anyone who submits, claims or manages a listing, purchases a service or provides content to WIP agrees to indemnify and hold harmless WIP and its owners, operators, employees, contractors and agents against claims, liabilities, losses, damages, penalties, costs and reasonable legal expenses arising from or connected with:

    •Their listing, submission or User Content.

    •Their breach of these Terms.

    •Their infringement of another person’s rights.

    •False, misleading or unlawful information supplied by them.

    •Their business, services, products or conduct.

    •Their violation of applicable law.

    •Their unauthorised submission, claim or management of a listing.

    16. Copyright and Rights Complaints

    Please identify the relevant page or content, explain the right concerned, provide your contact details and include sufficient evidence of your ownership, authority or legal interest.

    We may request further information and may restrict or remove disputed material while reviewing a complaint. We are not required to determine complex ownership or legal disputes and may leave content unpublished until the parties resolve the matter.

    18. Changes to the Website and Terms

    We may change the website, listing requirements, features, pricing and these Terms from time to time. Updated Terms take effect when published on this page unless another effective date is stated.

    Continued use of the website after updated Terms take effect constitutes acceptance of the changes to the extent permitted by law.

    19. Severability and No Waiver

    If any provision of these Terms is found to be invalid, unlawful or unenforceable, it shall be limited or removed only to the minimum extent necessary. The remaining provisions shall continue in full effect.

    A failure or delay by WIP in enforcing any right or provision does not constitute a waiver of that right or provision.

    20. Entire Agreement

    These Terms, together with the Disclaimer, Privacy Policy and any specific written terms provided for a particular paid service or transaction, constitute the agreement between you and WIP concerning your use of the website.

    21. Governing Law and Jurisdiction

    These Terms and any dispute arising from or connected with the website shall be governed by the laws of Thailand. Subject to any mandatory rights that cannot lawfully be excluded, disputes shall be submitted to the competent courts of Thailand.
