These Terms of Service govern your access to and use of WhatsInPattaya.com. By accessing or using this website, submitting or claiming a listing, creating an account, providing content, or purchasing a listing or service, you agree to these Terms, our Disclaimer and our Privacy Policy. If you do not agree, you must not use the website or submit content.

1. About WhatsInPattaya.com

WhatsInPattaya.com (“WIP”, “we”, “us” or “our”) operates an independent online business directory, property-listing platform and local information website covering Pattaya, Chonburi Province and surrounding areas.

Listings may be submitted by businesses, owners, authorised representatives or other users, or may be created or compiled by WIP using publicly available information and other lawful sources.

The appearance of a business or property on WIP does not necessarily mean that the relevant owner, business, representative or organisation submitted, claimed, approved or paid for the listing.

2. Business Listing Types

WIP may offer Basic (FREE), Premium and Featured Business listings. The features, eligibility requirements, prices, duration and promotional benefits applicable to each listing type are those displayed on the website or otherwise communicated by WIP at the relevant time.

Listing packages and eligibility requirements may change from time to time.

3. Eligibility for Basic (FREE) Listings

Basic (FREE) listings are available only to business categories expressly designated by WIP as eligible for free listings.

At present, eligible categories include:

Other businesses, including professional services, real estate agencies, lawyers, visa agents, vehicle-rental businesses, car-rental businesses, motorbike-rental businesses, clinics, dentists, pharmacies, tattoo studios, cleaning services, builders, activity providers, live-streaming bars and other categories not expressly designated as eligible for a Basic (FREE) listing must use an applicable paid listing.

Having physical premises that customers can visit does not by itself make a business eligible for a free listing.

Licensed hotels may qualify for free listings. Airbnb properties, private rentals, serviced apartments and similar accommodation businesses do not qualify merely because accommodation is offered.

Where a Basic (FREE) listing is selected, WIP may require the submitter to identify the business type before proceeding.

Deliberately selecting an incorrect category, misrepresenting the nature of a business or otherwise attempting to obtain a free listing for an ineligible business may result in rejection, recategorisation, removal of the listing, restriction of the account or a requirement to purchase an appropriate paid listing.

4. What a Basic (FREE) Listing Includes

A Basic (FREE) listing is intentionally limited. Its purpose is to provide essential information allowing visitors to identify a venue, see when it is open and find its location.

WIP may determine the format, layout, fields and information displayed on Basic (FREE) listings.

5. Listing Review, Approval and Processing Priority

All listings may be reviewed before publication. WIP may approve, reject, edit, correct, reformat, recategorise, restrict, postpone, unpublish or remove a listing at its discretion.

Paid listing submissions receive processing priority. Once a paid submission has been accepted in principle and any required payment has been received, WIP will normally seek to process and publish it as quickly as reasonably practicable.

Basic (FREE) listing submissions are reviewed according to available capacity and operational priorities. No guaranteed review, approval or publication timeframe applies to free listings.

The order in which submissions were received does not require WIP to process them in that order.

Payment does not oblige WIP to publish unlawful, misleading, inappropriate or otherwise unacceptable content.

6. Claiming and Managing Listings

The ability to claim and directly manage a listing depends on the business category and listing type.

Businesses that qualify for a Basic (FREE) listing may be permitted to claim and manage their listing without purchasing a paid listing, subject to identity, authority and ownership verification and any account requirements imposed by WIP.

Businesses that do not qualify for a Basic (FREE) listing may not claim or obtain management control of an existing listing unless they purchase an applicable Premium or Featured Business listing.

For example, an eligible restaurant, bar or licensed hotel may be permitted to claim an existing listing. A law firm, real estate agency, visa agency or other paid-category business must purchase an eligible paid listing in order to obtain management control.

A request to claim a listing does not automatically establish ownership, authority or entitlement to control the listing.

WIP may request evidence of identity, business ownership, employment, management authority or other relevant information before granting control.

We may refuse, delay, suspend or cancel listing-management access where authority cannot be established, conflicting claims are received, information appears inaccurate or there are other reasonable concerns.

7. Corrections to Unclaimed Listings

A business owner or authorised representative may contact WIP if an unclaimed listing contains materially inaccurate or outdated information.

Providing corrected information does not create a right to claim, manage or control the listing.

WIP may review, verify, accept, reject, amend or disregard requested corrections at its discretion.

For businesses that are not eligible for free listing management, repeated requests for routine updates, promotional changes, new photographs, menu changes, service changes or other ongoing listing administration may require the business to purchase a paid listing and claim management control.

8. Free Listing Maintenance and Removal

Basic (FREE) listings are provided at WIP's discretion. WIP is under no obligation to create, publish, retain, continually monitor or continually update any free listing.

We may update free listings where reasonably convenient, but free listings do not include an entitlement to ongoing manual administration or unlimited amendments by WIP.

Where a free listing requires disproportionate administration, repeated manual amendments, persistent management requests or other ongoing resources, WIP may decline further updates, require the eligible business to claim and manage the listing itself, or unpublish or remove the listing.

WIP may also remove a free listing where we reasonably consider it outdated, inaccurate, duplicated, no longer useful, low quality, no longer eligible, no longer operating, contrary to these Terms or otherwise unsuitable for continued publication.

9. Premium and Featured Business Listings

Premium and Featured Business listings provide additional features that may include direct contact details, website links, social-media links, additional photographs, enhanced directory visibility and other features displayed for the applicable package.

Featured Business listings may also receive priority positioning, prominent promotional placement, banner advertising, social-media promotion and other promotional exposure.

The precise location, frequency, rotation, format and visibility of Featured Business promotion may vary according to website design, available advertising space, device type, editorial requirements and operational considerations.

No particular position, number of impressions, views, clicks, enquiries, social-media posts, customers, sales or commercial result is guaranteed unless expressly agreed in writing.

10. Paid Listing Payments

Premium and Featured Business listings require payment.

After reviewing a submission, WIP may provide payment instructions, including our Thai company bank account details, by email. Payment must be made by bank transfer unless another payment method is expressly agreed by WIP.

A paid listing will not normally be activated until the applicable fee has been received as cleared funds.

The applicable price, listing period and included features are those displayed on the website or confirmed to the purchaser before payment.

All paid listing fees are non-refundable once paid, including where the purchaser later changes their mind, stops trading, fails to provide required information, requests early removal or does not receive the commercial response expected, except where a refund is required by applicable law or expressly agreed by WIP in writing.

Payment does not guarantee enquiries, bookings, customers, sales, revenue, website traffic, search-engine rankings, social-media reach or any other commercial result.

11. Photographs and Listing Images

Photographs and images submitted for a listing must genuinely relate to and represent the business, venue, property or service being listed.

Suitable business images may include genuine photographs of premises, interiors, facilities, products or staff connected with the business.

Stock photographs, AI-generated images, unrelated photographs, misleading images or content that falsely represents the business may be rejected or removed.

WIP may crop, resize, compress, reformat, reorder or decline submitted photographs where reasonably required for website presentation, quality control or moderation.

12. Accuracy and Updates

Submitters and listing managers are responsible for ensuring that information they provide is accurate, lawful, current and not misleading.

Listing managers are responsible for notifying WIP or updating their listing where material information changes, including addresses, contact information, opening hours, ownership, prices and available services.

Although WIP may independently correct or update information, we are under no obligation to continuously monitor every listing or guarantee that all information remains accurate, complete or current.

13. User Content and Permissions

You remain responsible for all text, photographs, videos, logos, graphics, documents, contact details and other materials that you submit, upload, send or otherwise make available to WIP (“User Content”).

By providing User Content, you represent and warrant that:

By submitting User Content, you grant WIP a non-exclusive, worldwide, royalty-free licence to host, store, copy, reproduce, crop, resize, compress, format, edit, adapt, publish, display, distribute and promote that content for the purposes of operating, marketing and improving WIP and the relevant listing.

This licence includes permission to use submitted content in website pages, directory results, search results, previews, promotional material and WIP social-media channels.

The licence continues for as long as the relevant content is published and for any reasonable period required for backups, records, legal compliance and administration after removal.

14. Prohibited Content and Conduct

You must not use WIP to submit, publish or distribute anything that is unlawful, fraudulent, deceptive, defamatory, threatening, abusive, discriminatory, obscene, malicious, infringing or otherwise inappropriate.

WIP may refuse listings for particular types of business or activity where we consider publication inappropriate, legally restricted, inconsistent with our advertising policies or unsuitable for the website.

At present, cannabis dispensaries and cannabis businesses are not accepted for listing due to advertising restrictions and related compliance considerations.

WIP may add, remove or amend restricted categories at any time.

16. Website Content and Intellectual Property

Except for third-party and User Content, the WIP name, branding, logo, design, layout, original descriptions, graphics, photographs, compilations, database organisation and other original website content are owned by or licensed to WIP and are protected by applicable intellectual-property laws.

Business names, trademarks, logos, photographs and other third-party materials remain the property of their respective owners. Their appearance on WIP does not transfer ownership to us or imply sponsorship, affiliation or endorsement.

You must not systematically copy, scrape, extract, reproduce, republish, sell, license, distribute or use WIP content to create or support a competing directory, database, website, product or service without our prior written permission.

Limited quotation or linking for legitimate personal, editorial or informational purposes is permitted where allowed by law, provided the source is properly identified and the use is not misleading.

17. Review, Removal and Account Restrictions

WIP reserves the right, but assumes no obligation, to monitor submissions and website activity.

We may reject, edit, correct, reformat, recategorise, restrict, postpone, unpublish or remove any listing, account or other content where we reasonably consider it inaccurate, misleading, duplicated, outdated, unauthorised, unlawful, infringing, unsafe, abusive, low quality, contrary to these Terms or otherwise unsuitable for WIP.

We may change a listing category or require a paid listing where we determine that a business does not qualify for a Basic (FREE) listing.

Where an account or listing-management function is provided, we may restrict, suspend or terminate access where reasonably necessary to protect WIP, website users, listed businesses or third parties.

We may act without advance notice where immediate action is reasonably necessary.

Removal, restriction or refusal of content does not constitute an admission that the content was unlawful, inaccurate or infringing.

18. Third-Party Businesses and Advertisers

Any communication, visit, booking, purchase, payment, transaction, contract or other dealing between a website user and a listed business, advertiser, service provider, property owner, agent or other third party is strictly between those parties.

Unless expressly agreed otherwise in writing, WIP is not a party to, agent for, guarantor of or adviser in relation to those dealings.

We do not guarantee the identity, reliability, legality, qualifications, products, services, conduct or performance of any listed person, business or organisation.

WIP is under no obligation to investigate, mediate or become involved in disputes between website users, businesses, advertisers or other third parties.

19. Real Estate Listings and Property Services

WIP may accept listings for property for sale or rent, including condos, houses, villas, land, commercial property, rental property and businesses offered for sale.

There is ordinarily no upfront listing fee for an owner to submit eligible property for sale or rent through WIP.

Submission does not create any obligation on WIP to publish, promote, sell or rent the property, nor does it guarantee enquiries or a successful transaction.

Unless a different arrangement is expressly agreed in writing before the relevant transaction, WIP's standard commission structure is:

Commission is payable following a successful transaction where WIP has earned commission under the applicable agency, introduction or co-agent arrangement.

Property listings are provided for informational and marketing purposes. Availability, prices, descriptions, dimensions, photographs and other details may change and must be independently verified.

We do not guarantee ownership, title status, legal compliance, permitted use, availability, condition, dimensions, pricing, rental terms or suitability of any property or business offered for sale.

Buyers, sellers, landlords and tenants are responsible for conducting inspections, checking ownership and title documents, obtaining appropriate legal and professional advice and completing their own due diligence.

Where WIP acts as an intermediary, introducing party, agent or co-agent in a particular transaction, additional transaction-specific terms may apply.

20. External Links and Third-Party Services

The website may contain links to external websites, maps, social-media pages, booking systems, messaging services, payment providers and other third-party resources.

These are provided for convenience only. WIP does not control and is not responsible for their availability, accuracy, security, privacy practices, content, products, services or conduct.

Accessing or using an external service is at your own risk and subject to that service's own terms and policies.

21. No Warranties

The website and its content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, WIP makes no representation or warranty that the website or any listing will be accurate, complete, reliable, lawful, suitable, secure, uninterrupted, error-free, continuously available or free from harmful components.

22. Limitation of Liability

To the fullest extent permitted by law, WIP and its owners, operators, employees, contractors and agents shall not be liable for loss, damage, cost or expense arising from or connected with:

Where liability relating to a paid listing or service cannot lawfully be excluded, WIP's total aggregate liability shall not exceed the amount actually paid to WIP for the specific listing or service giving rise to the claim.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

23. Indemnity

To the fullest extent permitted by law, anyone who submits, claims or manages a listing, purchases a service or provides content to WIP agrees to indemnify and hold harmless WIP and its owners, operators, employees, contractors and agents against claims, liabilities, losses, damages, penalties, costs and reasonable legal expenses arising from or connected with:

26. Changes to Listings, Pricing and These Terms

WIP may change the website, listing requirements, free-listing eligibility categories, features, package names, pricing, promotional benefits and these Terms from time to time.

Updated Terms take effect when published on this page unless another effective date is stated.

Continued use of the website after updated Terms take effect constitutes acceptance of the changes to the extent permitted by law.

27. Severability and No Waiver

If any provision of these Terms is found to be invalid, unlawful or unenforceable, it shall be limited or removed only to the minimum extent necessary. The remaining provisions shall continue in full effect.

A failure or delay by WIP in enforcing any right or provision does not constitute a waiver of that right or provision.

28. Entire Agreement

These Terms, together with the Disclaimer, Privacy Policy and any specific written terms provided for a particular paid service, listing, advertising arrangement or property transaction, constitute the agreement between you and WIP concerning your use of the website.

29. Governing Law and Jurisdiction

These Terms and any dispute arising from or connected with WIP shall be governed by the laws of Thailand.

Subject to any mandatory rights that cannot lawfully be excluded, disputes shall be submitted to the competent courts of Thailand.
